Anti-Gay Marrage Atty Subpoenas Activist Karger

A California gay rights activist says an anti-gay marriage group is trying to silence him, by subpoenaing his group’s financial and communication records.

Anti-gay marriage group Protect-Marriage-dot-com is trying to change California’s donor disclosure law, which currently requires that anyone who donates 100-dollars or more to a political campaign, do so publicly.

Fred Karger is founder of Californians Against Hate – which currently lists the names and addresses of all donors to last year’s Proposition 8 campaign. Karger says just he wants people to know they will be held accountable for their actions.

Karger: “It’s a free country, they can give as much as they want, they have to abide by the reporting laws, and that’s the way it works. I want people to think long and hard before they write out a big check to take away the rights of a minority.”

But attorney Jim Bopp of Illinois, who represents Protect-Marriage-dot-com says he thinks Karger’s records will show that he was trying to intimidate anti-gay marriage donors, and in his words, had an “intent to encourage harassment.”

Bopp told OutQ News that other controversial political groups, like the Socialist Workers Party, are already exempt from California’s public disclosure laws. Bopp also called Karger an “anti-Mormon bigot” and said “the government shouldn’t be rolling over for a bigot.”

Karger said comments like that are just another part of Bopp’s strategy.

Karger: “It’s insulting, it’s obviously not true, it’s trying to demonize the people they have been trying to take rights away from for 13 years. We’re fighting back, and they don’t like it.”

Under the subpoena, Karger must produce his group’s financial records and all communications and documentation regarding donor information. He will appear for a deposition on October 13th.
